"خلاف الأصل" في جوهره مفهوم يعبر عن وجود إشكال ما في البنية المعرفية والمنهجية لعلم أصول الفقه. فهو علامة على إدراك العقل التشريعي المسلم عدم وفاء القواعد والمناهج الأصولية الأساسية في بعض الموارد بمراعاة مراد الشارع ومقاصد الشرع في تحقيق مصالح العباد. ولذلك كان "خلاف الأصل" ملاذاً غايته تجاوز هذا الإشكال.
والكتاب الذي بين أيدينا يمثل أول محاولة علمية ممحضة لتناول هذا افشكال في المنهجية التشريعية الإسلامية على نحو شامل ومستقص. فمن خلال عملية تحليل وإعادة تركيب للعناصر والأبعاد المختلفة لهذا المفهوم استطاع المؤلف أن يتوصل إلى نتائج طريفة تجلي جانباً مهماً من التوتر الداخلي لمنظومة علم الأصول وتفتح بعض الآفاق لتجاوزه. وقد كان لاستحضار المؤلف لفكرة مقاصد الشريعة أثر واضح في توجيه خطوات البحث وصياغة الحجج وبناء الاستدلال.
وعسى أن يكون في نشر هذه الدراسة تحريك لسواكن الفكر وحفز للدرس الأصولي كي يتجاوز حالة الركود والاجترار التي آل إليها منذ عهد بعيد.
