يجري التمييز عادة في المركز الدستوري لرئيس الدولة ، وفقاً للنظام الدستوري الذي يعمل في ظله ، فيبرز دوره في النظام الرئاسي على نحو يجمع بين يديه غالبية الصلاحيات التنفيذية الهامة فضلاً عن بعض الصلاحيات التشريعية والقضائية ويتراجع دوره وينحسر الى أقصى حد في النظام البرلماني التقليدي ، حيث يغدو مجرد رمز لوحدة الدولة ، والحكم الذي يفصل النزاع اذا مادب بين السلطتين التشريعية والتنفيذية.
