الحمد لله رب العاملين والصلاة والسلام على رسوله الأمين وعلى آلــه وصحبه ومن والهم إلى يوم الدين. يحتل القانون البحري أهمية بالغة، بين فروع القانون الخاص ،وتبرز أهمية هذا القانون في الدول البحرية، حيث تتخذ هذه الدول من البحر منفذا تجاريا لـهـا ، بل أن هذه الدول غالبا ما تتخذ من البحر طريقا لصادراتها ووارداتها ، لما يتمتع به هذا المنفذ من مزايا.
فالنقل البحري أقل كلفة وخطرا قياسا لأنواع النقل الأخرى ( البري والجوي) من هنا جاء الاهتمام الدولي به مبكرا ، ففي عام ١٨٩٧ تشكلت في أنفرس ببلجيكا هيئة خاصة لدارسة مشاريع القوانين البحرية التي تعدها البرلمانات في الدول الأخرى.
