كنت قد ألفت مصنفاً عالجت فيه جميع الجوانب المتعلقة بالرخصة الادارية، كما تلمست الروح العملية لهذه الظاهرة متمثلة بالتطبيق القضائي لها، كل ذلك على ضوء القانون الوضعي في فرنسا ومصر وسوريا.
ولقد لاحظت من خلال معانقتي للموضوع، وتعاملي معه واحتكاكي مدى التداخل العميق بين تلك الظاهرة وبين عقد الايجار الاداري تداخلاً يورث الاشتباه، ويوقع الاختلاط، ويكسب الاضطراب والقلق عند تحديد ماهية الظاهرتين وطبيعتهما الذاتية وآلية عملهما، وهذا ما نهض بي وحفز همتي إلى المحاجزة العلمية الدقيقة بين الظاهرتين والفصل الحاسم بينهما، فصلاً لا يتأتى من خلال الاكتفاء بدراسة النظرية العامة للرخصة الادارية، ولا يؤدي اكله وثماره المرجوة إلا من خلال تخصيص بحث مستقل وقائم لعقد الايجار الاداري.
