في كل القوانين الدولية وحقوق والطفل وحقوق الانسان في العالم تنص على أن الطفل إذا اقترف جناية كبرى كجريمة قتل الا وهي أكبر الجرائم الجنائية يتم التعامل معه بطريقة إنسانية حتى أنه لايتم محاكمته كمجرم وانما يتم وضعه داخل ما يسمى إصلاحية نفسية بحيث ان الجرم الذي اقترفه هذا الطفل لايؤثر على حياته المستقبلية وسلوكه المستقبلي حيث يتم ترميم ما كسر في شخصيته ،
إلا الطفل الفلسطيني الذي يقبع تحت إحتلال غاشم حيث يتم التعامل معه بقسوة وهمجية ويتم تحطيم كل معالم شخصيته بالحكم عليه بالسجن الا وهو أسوء عقوبة عرفها التاريخ لطفل قاصر تحت السن القانوني .
ومعظم الأسرى الفلسطينين داخل السجون ، يتم اعتقالهم وهم تحت السن القانوني ويتم محاكمتهم وتنفيذ أحكام بحقهم وهم قاصرين
