يعالج المؤلف في هذه الدراسة الخطوط العامة للمنهج القانوني، وذلك من خلال بيان المقصود بالمنهج القانوني والأسس المنهجية للبحث العلمي بوجه عام، وفي مجال القانون بوجه خاص.
المنهج هو الطريق الجلي، ولقد جاء في القرآن الكريم الآية الكريمة: (لكل جعلنا شرعة ومنهاجاً) "المائدة/ الآية: 48"؛ والمنهج القانوني Legal Method: "هو المنهج الواضح - أسلوب المعرفي الجلي - المطبق في مجال القانون، على مستوى التشريع (المنهج التشريعي) وعلى مستوى القضاء (المنهج القضائي) وعلى مستوى الفقه (المنهج الفقهي).
وتعتبر دراسات المنهجية القانونية - المنهج القانوني Legal methodology - methodology juridique من الدراسات حديثة العهد، إذ لا نجد فيها كتابات كثيرة، ولما أدرك الفكر الإنساني أهمية المنهج بالنسبة للعلوم بدأ يكرس إهتماماً أكبر لدراسة المنهجية في كل علم من العلوم.
وبناءً عليه، بدأ البحث في منهجية البحث العلمي، وخصائص المنهج العلمي، والمنهجية في الهندسة والمنهجية في القانون وهكذا...
فالمنهجية القانونية ينطوي تحت مفهومها: المنهجية التشريعية والمنهجية القضائية والمنهجية الفقهية، وكل هذه الصور تتعلق بدراسة القانون، ويوجد بينها قواعد مشتركة؛ كما ينبغي أن التأكيد أن دراسات المنهج القانوني مرتبطة إرتباطاً وثيقاً بمشكلة جودة العملية التعلمية في مجال القانون Quality assurance in law وهذا ما نجده ماثلاً فيما جاء في المعايير القومية الأكاديمية القياسية - قطاع الحقوق (الإصدار الأول 2009) وقطاع الدراسات العليا في القانون (مارس 2009).
ولأهمية هذا الموضوع تقسمت الدراسة على النحو التالي: مبحث تمهيدي: أساسيات المنهج القانوني، الفصل الأول: المنهجية في عمل الطالب، الفصل الثاني: المنهجية في عمل رجل القانون.
