ما أن يولد دستور في دولة أقل تطور وديمقراطية ، او سائرة توا على طريق الديمقراطية، إلا وتتولى التقييمات المجردة عن ظروف ولادته تترى، وكثيرا مايهاجمه الفقه ورجال السياسة، ويذهب كل منهم مغردا بالنقد والتجريح ، وكأن صانع الدستور دائما يجهل مايصنع، وماينتج ، ومايدون . لكن المقيم غالبا مايثبت وهو ينقد مايراه هو في ظرف مثالي ، وهو يجهل غالبا ، لماذا دون المصطلح؟ وكيف كتب؟ وما دواعي انتقاء هذه العبارة دون غيرها، من هنا آلينا البحث في خفايا صناعة الدستور ، متخذين من دستور جمهورية العراق لسنة 2005 أنموذجا لنكشف بعض ظروف صناعته ، وخفايا إنتاجه، كيف ينصف صناعه ، فالدستور وليد ظروف زمانه، اما ذلك الذي يصنع مجرد عن الزمان والمكان وحاجات المجتمع، يولد جسد دون روح ، ونص دون تطبيق ، ويقينا ان مثل هذا الدستور زواله اولى من حياته.
