Book Description
يهدف هذا الموضوع إلى تحديد المراد بالمزاح لغة واصطلاحًا، وبيان الألفاظ ذات الصلة به من حيث المعنى والحكم الشرعي.
كما يهدف إلى تقصي وجمع أقوال العلماء وأدلتهم ومناقشاتهم في أحكام المزاح عامة، وما يترتب عليه من آثار تجاه الآخرين.
وقد ظهر من خلال الدراسة أن المزاح في الإسلام قسمان: مشروع وممنوع. وأن للفقهاء قولين في أصل المزاح المشروع: فمن قائل: هو مندوب، ومن قائل: هو مباح. ولهذا ضوابط وأهداف وهيآت (أحوال) ونماذج مأثورة.
أما المزاح الممنوع فهو عندهم نوعان: حرام ومكروه، ولكلٍ أدلة وضوابط وشواهد ونماذج.
هذا، وقد اشتمل الموضوع أيضًا على آثار تصرفات المازح المتصلة بالنكاح، والطلاق، والرجعة (الأحوال الشخصية) والعقود والمعاملات المالية، والقضاء، والردة. وما يترتب على ذلك من حقوق والتزامات وجزاءات.
كما تضمن الكلام عن المزاح والمازحين في العصور الإسلامية الأولى، مع ذكر نماذج لذلك، من لدن النبي - صلى الله عليه وسلم - وصحابته - رضي الله عنهم - ثم من بعدهم من فضلاء التابعين وتابعيهم.
وقد أكدت الدراسة على ما تضمنته الإسلام من سماحة واعتدال في السلوك الاجتماعي مع الآخرين، مادام ذلك يدخل السعادة إلى القلوب، ويفرح النفوس، ويطبع البسمة على الأفواه، ويرضي الله تعالى.
