إن البحث في موضوع مساءلة الطبيب وتحديد أسس وشروط مسؤوليته ينبغي أن ينطلق من التوفيق بين مصلحة الجسم الطبي من ناحية ومصلحة صحة الإنسان والمجتمع من ناحية ثانية، من دون وضع مهنة الطب تحت سيف الملاحقة والمسؤولية بشكل يؤدي إلى منع تقدمها وتطورها، وهذا يفرض الإقرار بمبدأ مسؤولية الطبيب عن أخطائه الطبية ووضع الأسس والشروط الواضحة لهذه المسؤولية.
هذه المبادئ والقواعد التي تقوم عليها مسؤولية الأطباء وجدت صدىً لها في التشريع اللبناني، فبعد قانونين تناولاً المهنة الطبية، الأول قانون 7 كانون الأول 1946 وموضوعه إنشاء نقابتين للأطباء في لبنان، والثاني قانون 17 كانون الثاني 1979 وموضوعه تنظيم ممارسة مهنة الطب في لبنان، أصدر المشرع اللبناني قانون الآداب الطبية اللبناني رقم 288 تاريخ 22 شباط 1994 الذي تم تعديله بموجب القانون رقم 240 تاريخ 2012/10/22 والمتضمن تنظيماً لمهنة الطب في لبنان، ثم قانون حقوق المرضى والموافقة المستنيرة الصادر بالقانون رقم 574/ 2004، وقانون الصحة العامة رقم 2008/47.
وقد أحاطت هذه القوانين بجوانب كثيرة من ممارسة مهنة الطب والواجبات الملقاة على عاتق الأطباء وكذلك حقوقهم، إن الإخلال بهذه الموجبات، سواء عن قصد أو إهمال، يضع الطبيب في ظل أحكام المسؤولية العادية المنصوص عليها في قانون الموجبات والعقود وقانون العقوبات فيما إذا حدث ضرر للمريض، ولا يمكن التذرع بخطأ مهني لتخفيف المسؤولية عنه.
