يُشْكِل على كثيرين تَوجُّه المحكمة بالمسألة الفقهية التي سيُبنى عليها الحكم فإن قيل : أن المذهب المعمول به في المحاكم كما هو معروف هو مذهب الإمام أحمد رحمه الله .كما جاء في التقريرات ..... فيُقال : فإن تعددت الروايات و الأقوال في المسألة ؟ فضلاً أن من تأمل في الأحكام القضائية يجد بعضها يخالف المذهب و بعضها يخالف رأي الأئمة الأربعة , إذاً فما الحل ؟ من هنا أتت فكرة جمع اختيارات و اجتهادات المحكمة في المسائل الفقهية من خلال استقراء الأحكام القضائية المنشورة من قبل " وزارة العدل " و كنا نتمنى أن الوزارة قد نشرت أكثر مما نشرته بحيث يكون ذلك على غرار نشر ديوان المظالم لأحكامها أو أن تنشر أحكام المحاكم كما نشرت أحكام المحكمة التجارية و هذا هو الأفضل لأن انتقاء الأحكام لا يعكس الواقع و إنما يعكس رأي الوزارة و مركز البحوث بينما نشر جميع الأحكام أو النشر بشكل غير انتقائي هو المؤمل لتتسع دائرة البحث و نصل إلى قناعة أكثر فيما يتعلق بتوافق الأحكام أو اختلافها و لتعم الفائدة .
