يتناول الكتاب أهم الإشكاليات الدستورية التي ظهرت أثناء جلسات الهيئة التأسيسية الليبية، والتي تألفت بالانتخاب العام السري المباشر سنة 2014م، والتي منها مسائل كانت محل نقاش واسع في جلسات الجمعية التأسيسية لدستور الاستقلال الليبي 1951م. وبما أن الكاتب هو أحد أعضاء الهيئة التأسيسية، وعضو لجنة العمل الأولى ثم عضو بلجنة العمل الثانية ولجنة التوافقات النهائية، فإنه قد حاول ضبط وجهات النظر المختلفة مع تأسيسها وتأطيرها قانونا، وبيان أبعادها المختلفة… ومن أهم هذه الإشكاليات: شكل الدولة واسمها ونظام الحكم فيها، دين الدولة ومصدر التشريع، معايير بناء السلطة التشريعية بمجلسيها" مجلس النواب ومجلس الشيوخ"، العاصمة أو العواصم، اللغة الرسمية، حقوق الأقليات الثقافية واللغوية، ضمانات التنمية المكانية المتوازنة، رموز الدولة وشعاراتها…
