نشئت المحكمة الجنائية الدوليةمن أجل يوغسلافيا السابقةمقرها في لاهاي (هولنده) في شباط (فبراير) 1993م، بموجب قرار مجلس الأمن 808 ، وتقتصر ولايتها القضائية على الأعمال المرتكبة في يوغسلافيا السابقة منذ عام 1991م، وتشمل أربعة أنواع من الجرائم: أ- انتهاكات جسيمة لاتفاقيات جنيف المبرمة عام 1949م. ب- انتهاكات قوانين وأعراف الحرب. جـ- الإبادة الجماعية . د- جرائم ضد الإنسانية. وقد ورد تعريف هذه الجرائم في النظام الأساسي للمحكمة. اتهمت المحكمة عدداً من الأشخاص بجرائم، منهم سلوبودان ميلوسوفيتش ، ورادوفان كاراديتش وآخرون ، وإذا كان معظمهم ما يزال فاراً من وجه العدالة، فإن البعض الآخر اعتقل وقدم للمحاكمة، والآن يحاكم فيها سلوبودان. أصدرت المحكمة عدداً من القرارات في القضايا المتعلقة بالإجراءات والأمور الجوهرية، وأقفلت المحكمة الأولى في أيار (مايو) 1997م.
