تعريف حق الملكيــة : عرفت المادة 802 مدنى حق الملكية بقولها: "لمالك الشىء وحده فى حدود القانون, حق استعماله واستغلاله والتصرف فيه". فيبين من هذا النص أن حق ملكية الشيء هو حق الاستئثار باستعماله وباستغلاله وبالتصرف فيه على وجه دائم، وكل ذلك فى حدود القانون وكانت المادة ( 11/27) من التقنين المدنى القديم تعرف الملكية بقولها :"الملكية هى الحق للمالك فى الانتفاع بما يملكه والتصرف فيه بطريقة مطلقة". وهى مأخوذة من المادة 544 من التقنين المدنى الفرنسى التى تجرى بهذا المعنى.
