قد أشار ابن خلدون (ت 808هـ) إلى الجانب التأصيلي الشرعي وإلى الصور التطبيقية بقوله: "الحسبة وظيفة دينية، من باب الأمر بالمعروف والنهي عن المنكر الذي هو فرض على القائم بأمور المسلمين يعين لذلك من يراه أهلا له، فيتعين فرضه عليه، ويتخذ الأعوان، على ذلك"( ). ويرى ابن تيمية أحد أهم الأعلام الذين كتبوا في مجال الحسبة، ويرى أن للحسبة مجالات دينية ومدنية واسعة من خلال تحديده لوظائف المحتسب الذي كان له " الأمر بالمعروف، والنهي عن المنكر ... الخ
