لقد أولى المشرع المغربي لبيع عقار القاصر حماية قصوى نظرا لوضعية القاصر في المنظومة القانونية والاولوية التي يحظى بها، لكن فالقانون مهما سما وارتقى فقد تعتريه بعض النقائص أو الثغرات التي قد يستفيد منها البعض بغير وجه حق، وهنا يظهر ويبرز دور القضاء في إتمام وتكملة القاعدة القانونية أو تفسيرها تفسيرا يتناغم ومنطق العدالة والحق، ويعتبر موضوع بيع أو تفويت بصفة عامة للممتلكات العقارية للقاصر، موضوعا ذي أهمية على اعتبار أن القاصر قد لا يعرف مصلحته وقد يتكلف وليه أو وصيه بالقيام بتفويت عقاراته بدون وجه حق، وهنا يبرز دور القضاء في مراقبة هاته العملية وذلك من خلال مجموعة من الإجراءات الشكلية الواجب إتباعها، حماية لمصالحه المالية. وتتجلى أولى هذه الإجراءات في إذن القاضي المكلف بشؤون القاصرين بعد ثبوت مصلحة القاصر في هذا البيع
