بدأ المسلمون بالهجرة إلى الدول الغربية بعد منتصف القرن العشرين، جماعات ووجداناً، أسراً وأفراداً، بسبب ظروف شتى، ونتيجة لذلك وجد علماء الإسلام أنفسهم أمام ظاهرة لم تكن مألوفة من قبل، ولا عهد لسلفهم بها. فبدلاً من إقامة المسلمين في بلاد الإسلام. إذ بهم أو بكثير منهم يؤثرون العيش في مجتمع لا يمت إلى الشريعة بصلة، وهذا ما جعل العلماء يتحيرون أمام هذه الظاهرة، كما اضطربت أقوالهم في إطلاق الأحكام عليها. ولم يقف الاضطراب في فتاوى العلماء المعاصرين عند حد الإقامة، بل تعداه إلى كل ما يتعلق بحياة المهاجرين في حربهم وسلمهم وبيعهم وزواجهم وسائر شؤون حياتهم، فمن المشايخ من أفتى بالخضوع لتلك الدول في جميع أحكامها، سواء ما يتعلق بالأحوال الشخصية أو المعاملات التجارية، دون التمييز بين ما تقره الشريعة وما تلا تقره، ومنهم من رأى أن هذه الدول محاربة للإسلام ولا يجوز التعدي على أحكامها وأموالها.
