قد لا يخفى على الكثير من الدارسين للتاريخ الإسلامي الحجم الكبير الذي خلفته النوازل والأحكام من إرث فكري ومعرفي ضخم، أبان عن مدى استيعاب الفقه الإسلامي عامة، والفقه المالكي خاصة لقضايا العصر المستمرة وتحدياته المتجددة، وما حوته هذه المصادر من مسائل جزئية قلما تطرقت إليها كتب الفقه وأصوله، ونظرا لما اتسمت به هذه المصادر من حس الواقعية والجدة، ساهمت بشكل أو بآخر في الإجابة عن أسئلة طرحت نفسها بإلحاح وعبرت عن هموم الناس ومشاغلهم اليومية.
لكن إذا نظرنا إلى هذه الوثائق (النوازل، الأحكام، الرسائل) التي بين يدينا، نعاين أنها تجاوزت دورها الأصلي وما أنيط بها من إيجاد حلول واقعية لإشكالات روحية وفكرية لأهل البادية الصحراوية، إلى دور التأريخ والتحقيب لمنطقة الصحراء نهاية القرن التاسع عشر وبداية القرن العشرين، حيث استوعبت هذه الوثائق بين طياتها أرشيفا لمجتمع بدون أرشيف، وتاريخا غير ناطق، وذاكرة لا إرادية، صمتت عنها المصادر التقليدية والأجنبية (التقارير، الرحلات الاستكشافية، الحوليات...) التي كتبت التاريخ إما لأدلوجة كاتبها أو حالت دون ذلك معوقات معرفية تمثلت في القصور عن استيعاب اللغة والمجتمع وثقافته بشكل أقرب وأعمق.
يرصد هذا الكتاب تاريخ أهل الصحراء وعاداتهم وتقاليدهم، ناهيك عن مظاهر الحياة وشظف العيش، وخشونة البيئة وقساوتها، كما أفصحت هذه الوثائق عن أنشطة اجتماعية واقتصادية وفكرية طبعت الحياة اليومية لأهلها، لتشكل منبعا أصيلا، ومخزونا حفظ الذاكرة التاريخية لأهل الصحراء.
هذا المعطى يدفعنا لإعادة التفكير في دور الوثائق (النوازل، الأحكام، الرسائل...) وأهميتها في إعادة صياغة وكتابة التاريخ، وسد " المجاعة " المصدرية للبحث العلمي في منطقة الصحراء بوادي الساقية الحمراء ووادي الذهب.
