يعد قيام الدولة الفدرالية تجسيدا عمليا لفكرة الفدرالية ، والتي تتمثل باتحاد دستوري بين دولتين او اكثر ، او نتيجة تحول دولة موحدة بسيطة الى الفدرالية تفاديا لنزعة الانفصال فيها ، لما تتصف به من تعددية وتمايز عرقي وديني ، بحيث تخضع الكيانات التي تشكل الاتحاد في امورها العامة لسلطة مشتركة ، تتولى مظاهر السيادة في الدولة الجديدة ، والتي تتوزع على مؤسساتها التشريعية والتنفيذية والقضائية ، لتمارس اختصاصاتها في كل اجزاء اقليم الدولة الاتحادية ( المستوى الاتحادي ) . والى جانب السلطة الاتحادية نجد سلطات اخرى تشريعية وتنفيذية وقضائية .
