اليوم، وفي ظل التعقيدات التي يشهدها المجتمع، تتعدَّد المصالح وتتقاطع فيما بينها، وبالنظر إلى كون فض هذا التعارض من صميم إختصاص القانون.
نرى أن التشريعات في مختلف الدول تتدخَّل لحل ذلك التعارض، إما بقواعدها العامّة وإما بقواعد خاصّة، ولا شك في أن أبرز حالات التعارض تكمن في إصطدام مصالح المستهلكين بمصالح المحترفين الذين يقومون بتقديم السلع والخدمات إنتاجاً وتوزيعاً، ويقومون بالترويج لها، ولا ريب في أن المستهلك يُعدُّ دوماً الطرف الأضعف في تلك المعادلة، وخصوصاً عندما يُبرم عقداً عن بُعد في بيئة إلكترونية من خلال شبكة الإنترنت وخدماتها، فهو بحاجة إلى أن تكون غاية التدخل التشريعي منصبَّة في مصلحته، على الأقل، لإعادة التوازن إلى الرابطة العقدية.
لقد تناول هذا الكتاب، بدراسة تحليلية معمَّقة، ما يفرزه النظام العقدي من حماية المستهلك، فقد اعتمدت الدراسة على إجراء مقارنة ممتازة بين قوانين عديدة حديثة عالجت موضوع حماية المستهلك، سواء على نطاق الدول العربية، كما في قانون حماية المستهلك اللبناني لسنة 2004، وقانون حماية المستهلك المصري لسنة 2006، وقانون حماية المستهلك الإماراتي لسنة 2006، وقانون المبادلات والتجارة الإلكترونية التونسي لسنة 2000، أو على نطاق القوانين الأجنبية، كما في تقنين الإستهلاك الفرنسي لسنة 1993، والتوجيه التشريعي الأوروبي بشأن حماية المستهلكين لسنة 1997.
وقد خلصت الدراسة إلى نتائج وتوصيات مهمَّة تستحق أن تكون نموذجاً يُحتذى به عند وضع أي مشروع لتقنين حماية المستهلك في الدول التي لم تعالج قوانينها هذا الموضوع المهم، ولا سيما في العراق.
