إن ظهور التجارة الإلكترونية وما رافقها من إنفتاح إقتصادي من جهة وتطور تكنولوجي من جهة أخرى أثر على كل مناحي الحياة وأفرز تعاملات تجارية غاية في التعقيد تستهدف المواطن وقد تعرضه للإستغلال والإحتكار بحيث يصبح المواطن المستهلك فريسة لمهني يملك كافة مقومات التفوق من نفوذ إقتصادي بجانب تفوقه المعرفي في الوقت الذي أصبحت فيه التشريعات والقوانين عاجزة عن حماية هذا المواطن الضعيف.
ومن هنا، جاءت الحاجة إلى ضرورة سن قوانين وتشريعات تتماشى وهذه التطورات وتتكفل بالحماية المنشودة لهذا الطرف الضعيف المتمثل في المستهلك.
تهدف هذه الدراسة إلى إيجاد الحلول الناجعة ولحماية المستهلك بعد التعاقد الإلكتروني من غبن التجار من خلال ما سنّ من قوانين أعدّت لهذا الغرض، وقد حاول البحث إستجلاء بعض المفاهيم أو المصطلحات القانونية التي اختلف في تعريفها.
ومن هذه المفاهيم التي تناولها البحث: مفهوم المستهلك بمعنييه الواسع والضيق، ومفهوم المهني، وكذلك تعريف العقد الإلكتروني الذي صنفته هذه الدراسة أنه عقد إستهلاك بإمتياز، كما تناولت هذه الدراسة وسائل الحماية المدنية للمستهلك - بعد التعاقد الإلكتروني - متمثلة في: حق الإلتزام بالتبصير أو الإعلام، ومكنة العدول، ومواجهة الشروط التعسفية في العقود.
واختتمت هذه الدراسة بالدور الذي تقوم به جميعات حماية المستهلك بشقيه الوقائي والعلاجي، وخلصت هذه الدراسة لعدة نتائج وتوصيات، آملاً أن تكون هذه الدراسة قد أسهمت ولو بقدر في إضفاء الحماية المنشودة للمستهلكين.
