إن العامل المحفز في حياة المسلم هو الله تعالى وذلك في كتابه القرآن الكريم، فهو مثال الكمال المنشود. إنه تعالى يمنحه السلطة المطلقة لأحكام القرآن الشرعية الواضحة والقطعية. والتي تتجاوز حياة الإنسان في الدنيا وتحدد حياته في الآخرة، ولذلك فاقتراب التشريع الإسلامي من المنطق الديكارتي يشوّهه، لذا يجب تحليله عبر منطقة الخاص، المفقود تقريباً في الوقت الحاضر. لكنه موجود ويبقى بحاجة للتوضيح. من هذا المنطلق يأتي عمل الباحثة وذلك في دراسة لنظامية مصادر التشريع الإسلامي. وهي تبدأ بتحديد مجال البحث الذي سيتناوله موضوعها والإجابة عن السؤال التالي: أي تشريع إسلامي تدرس؟ لذا سيتناول البحث خاصية هذا التشريع وتعريفه بالنظر إلى مصادره والإجابة عن السؤال الثاني: إلى أي حد يبقى هذا التشريع في تطوره على علاقة مع مصادره.
وقد رتبت الباحثة مواضيع الكتاب وفق المنهجية التالية: ولاً تحديد مجال البحث: التشريع السني، مذاهب التشريع السني، ثانياً التشريع الإسلامي وخصائص تطوره: الشرع، السنة، الفقه، موقع الفقه من مصادر الشرع. ثالثاً: مصادر التشريع الإسلامي في إطارها القرآني: المرتكزات النظامية الشرعية، التوجيه في النظام القرآني، المنهج الشرعي للاجتهاد.
