يدور موضوع الكتاب حول النظام السياسي الإسلامي، الرامي إلى إقامة حكم الله في الأرض، وحفظ الدين، وتنفيذ أحكامه، وقمع الفتن، وإنقاذ الجنس البشري من الضلال وهدايته.
يعرّف الدكتور "شوكت عليان" السياسة الشرعية في الإسلام بأنها "السياسة التي لا تصادم الشرع الشريف والتي تكون راجعة إلى نص كلّي فيما لا نص فيه بخصوص ومرجعها إلى اتخاذ التدابير في تنفيذ الأحكام الشرعية وفيما يعود على الأمة بالمصلحة العامة من درء مفسدة أو جلب مصلحة (...) وقد منحت الشرعية الإسلامية ولاة الأمور صلاحيات واسعة في أن يعملوا ما تقضي به المصلحة مما لا يخالف أصول الشريعة ومبادئها العامة وقواعدها الكلية، فهي ترعى مصالح الناس في تدبير شؤون حياتهم من إثبات حقوقهم ودفع الأضرار عنهم ونحو ذلك (...) إذ لا يستقيم حكم صالح إلا بقضاء صالح، ولا تتم رسالة التشريع إلا برسالة القضاء ...".
جاء الكتاب في خمسة فصول: تحدث الفصل الأول عن نشأة الدولة الإسلامية ودعائم النظام السياسي في الإسلام. أما الفصل الثاني فتحدث عن الخلافة في النظام السياسي الإسلامي، ومراحلها، وبيعة أهل الحل والعقد، والواجبات والحقوق المتعلقة بالخليفة ونحو ذلك. في حين تحدث الفصل الثالث عن السياسة الخارجية والداخلية للدولة الإسلامية، في السلم والحرب والحياد ... ويعدد الفصل الرابع السلطات في السياسة الشرعية وفي النظم الوضعية، في عصر الصحابة وعصر التابعين ومن بعدهم إلى منتصف القرن الرابع الهجري، ويتطرق إلى السلطة القضائية، والسلطة التنفيذية، والفرق بين الخلافة والوزارة، والإمارة العامة والإمارة الخاصة، ويوضح العلاقة بين السلطات الثلاث الآنفة الذكر. أما الفصل الخامس والأخير فيأتي على عرض مفصل من مظاهر تطبيق النظام السياسي في المملكة العربية السعودية. ويختتم الكتاب بنتائج وخلاصات ...
