حقوق الإنسان، أو الحقوق الأساسية للشخص، أو الحريات العامة، كلها صيغ تستخدم بلا تفرقة وتمييز تقريبا وقد أجملتها الثورة الفرنسية في الحرية والإخاء والمساواة، وعربت عنها المواثيق الإنجليزية بتعهد الملك باحترام حقوق الناس، بينما صورتها الدولة الاشتراكية أو الماركسية تصويراً مادياً بحتاً، ثم جاء الإعلان العالمي لحقوق الإنسان 10 من كانون الثاني عام 1948 ليضفي عليها طابعاً دولياً عاماً نتيجة إقراره من المجتمع الدولي بكل شعوبه وأجناسه.
ومع ذلك فإن حقوق الإنسان تظل على رأس القضايا التي تشغل الرأي العام العالمي فهي مهدرة في كثير من البلدان الأمر الذي يوجب تدعيم احترامها وتنمية الشخصية الإنسانية في مجالها وتحقيقاً لهذا الغرض شاع تدريسها على المستوى الجامعي ولا أدل على ذلك من البحث الميداني الذي قام به المعهد الدولي لحقوق الإنسان في فرنسا عام 1977 بالتعاون مع جمعية القانون الدولي العام ومعهد الولايات المتحدة لحقوق الإنسان الذي كشف عن مدى انتشار تدريس تلك المادة في أغلب الجامعات الأوروبية والأمريكية وجامعات دول العالم الثالث، كما كشف البحث السالف الذكر أن الاتجاه الأكثر شيوعاً هو تدريس تلك المادة في إطار دراسة مادة القانون الدستوري وذلك على أساس أن حقوق الإنسان تنتمي إلى العلاقات القائمة بين الدولة والأفراد، أما الاتجاه الآخر غير الشائع فيعتبر حقوق الإنسان جزءاً لا يتجزأ من دراسة مادة القانون الدولي العام "المنظمات الدولية" وهناك اتجاه ثالث يرى استقلال مادة حقوق الإنسان.
ويمكن القول أن إبراز ذاتية مستقلة لمادة حقوق الإنسان كاتجاه حديث لا يعني إقامة سد منيع بينها وبين أي من فروع القانون الأخرى وإنما يعني لم شتات موضوعاتها باقتطاف أجزائها المتداخلة بفروع القانون المختلفة لتلتئم تحت عنوان "حقوق الإنسان".
وحتى يتسنى إيضاح ذلك فقد تم تقسيم موضوع هذا البحث إلى ثلاثة أبواب: الباب الأول: في المفهوم القومي لحقوق الإنسان. الباب الثاني: في الوعي العالمي لحقوق الإنسان، الباب الثالث: في حقوق الإنسان وحرياته في المملكة الأردنية الهاشمية.
