أن مبدأ التكامل، هو واحد من أهم مبادئ القانون الجنائي الدولي الحالي، وهو الركيزة الأساسية التي تقوم عليها المحكمة الجنائية الدولية، وقد حظي هذا المبدأ بقبول واسع منذ بداية الأعمال التحضيرية لإنشاء المحكمة الجنائية الدولية، فقد أرادت الدول للمحكمة أن تكون مكملة للقضاء الوطني لا أن تسمو عليه، فالمحكمة الجنائية الدولية ليست بديلا للقضاء الوطني، ولا جاءت لكي تحل محله.
بل إن إنشاء المحكمة جاء لكي تكون الجهة التي تختص قضائيا بالجرائم الأشد خطورة على المجتمع الدولي، حينما تغفل أو نتغافل النظم القضائية الداخلية عن مثل هذه الجرائم ومن هنا تظهر لنا أهمية التعريف بمبدأ التكامل، إذ أنه يرسم الحدود الفاصلة بين ما يختص به القضاء الجنائي الدولي وما يختص به القضاء الجنائي الوطني.
من هنا، قسمت هذه الدراسة إلى أربعة فصول هي، الفصل التمهيدي، وفيه نسعى إلى توضيح ماهية مبدأ التكامل والتعريف به، ونرى المبررات التي دعت إلى النص عليه، وما هي أنواع التكامل بشكل عام.
وتتطرق في الفصل الأول إلى أعمال مبدأ التكامل، فنرى إعمال مبدأ التكامل من قبل القضاء الوطني، وإعمال مبدأ التكامل من قبل المحكمة الجنائية الدولية، ونبحث في أولوية إختصاص القضاء الوطني، وفي الفصل الثاني، نبحث في آثار تطبيق مبدأ التكامل، مع محاولة للإجابة عن التساؤلات التي قد يثيرها تطبيق مبدأ التكامل.
