يكتسب موضوع [الحماية الجنائية للصحفي] أهميته الخاصة من اتصاله بشريحة مهمة من شرائح المجتمع إلا وهم الصحفيين، الذين دائماً ما يتعرضون للمخاطر والإنتهاكات كونهم يُعتبرون مجهر كشف الحقائق للرأي العام.
ولا نبالغ إذا قلنا أن الصحفي في أي مجتمع له دور عظيم ويضطلع بمهمة ترتقي إلى مهام السياسي، لأنه يمارس دور الرقيب والراصد ليضع الرأي العام في قلب الحدث، وهذه المهمة رغم إنها صعبة ومحفوفة بالمخاطر وربما تعرض من يضطلع بها إلى فقدان حياته كثمن للحصول على المعلومة – خاصة على صعيد الساحة العراقية – إلا أنها مهمة نبيلة وراقية، لأن الصحفي هو العين والرقيب والراصد لما يدور حوله، ومن ثم فإن هذا الدور يؤهله لأن يكون موجهاً للأحداث شريطة أن يراعي موجبات العمل الصحفي وهي الحيادية والبحث عن الحقيقة وخدمة الرأي العام وتقديم المعلومة التي تأخذ بنظر الإعتبار مصالح الوطن وموجبات الحفاظ على أمنه لتجسيد آمال وتطلعات جمهوره في العيش بأمان واستقرار بعيداً عن الإثارة الصحفية التي قد توقع الصحفي في المحظور.
سنتناول في هذا البحث دراسة الحماية الجنائية للصحفي في شقيها الموضوعي والإجرائي، مستندين في ذلك إلى عرض وتحليل النصوص القانونية في التشريع العراقي يالتي عالجت الموضوع ومقارنتها بالتشريع المصري والفرنسي مع الإستئناس في بعض الأحيان بمواقف بعض التشريعات العربية الأخرى.
ويقتضي إيفاء هذا الموضوع حقه تقسيمه إلى اربعة فصول، حيث نخصص الفصل الأول لتوضيح العنصر الشخصي في مهنة الصحافة والمتمثل بالصحفي والعنصر الموضوعي والمتمثل بالعمل الصحفي، وذلك تحت عنوان (عناصر مهنة الصحافة).
أما الفصل الثاني المعنون بـ (الحماية الجنائية للصحفي في إطار التجريم والعقاب)، فقد خصص لبحث الجرائم الواقعة على الصحفي.
بينما يتضمن الفصل الثالث بحث (الحماية الجنائية للصحفي في إطار الحرية المهنية).
أما الفصل الأخير فتطرقنا فيه إلى (الحماية الجنائية للصحفي في إطار الإجراءات الجنائية).
وقد انتهى البحث بخاتمة تتضمن أهم النتائج وأهم المقترحات التي تبلورت من هذا البحث.
