أصل هذا الكتاب رسالة قدمها الدكتور "ملاطف محمد صلاح مالك" لنيل شهادة الماجستير وناقش فيها موضوع الأمر ودلالته على ألأحكام الشرعية، وأثر ذلك في اختلاف الفقهاء حيث اجتهد بتبسيط المسائل بأسلوب واضح مفهوم متبعاً طريقة وهي أن يقرر المسألة ويبين المراد منها ويحرر موطن النزاع فيها إن كانت المسألة بحاجة إلى ذلك. وفائدة هذا أن يكون الباحث على علم بمحل النزاع حتى لا يحصل هناك ليس أو غموض. فإذا تقررت المسألة ذكر مذهب العلماء فيها سواء كانوا جملة أو فرادي وحاول قدر الإمكان أن يذكر من نسب القول إليهم وذلك حرصاً على التأكد من صحة نسبه هذا القول إليهم.
ثم بعد تقرير مذاهب العلماء في المسألة يذكر أدلة كل مذهب على النحو التالي: يذكر الدليل ويذكر بعده الاعتراض عليه إن كان هناك اعتراض على الدليل ثم يذكر بعده مباشرة الجواب على الاعتراض إن وجد ثم في نهاية كل مسألة يذكر الرأي المختار مدعماً بالدليل ولم يلتزم مذهباً معيناً في الترجيح لأن الغاية والهدف هو الوصول إلى الحق الذي تطمئن إليه النفس.
ثم بعد ذلك كله يذكر أثر هذه المسألة في اختلاف الفقهاء ويرجع في ذلك إلى كتب الفقه المعتمدة في كل مذهب مع الرجوع إلى كتب أخرى تتصل بالموضوع كالتفسير والحديث وغيرهما. وقد اكتفى في أثر اختلاف الفقهاء في الفروع على ذكر مسألتين في الغالب في كل قاعدة من قواعد الأصول وقد يزيد أحياناً في بعض المواضيع فتصل إلى أربع مسائل وذلك حرصاً على عدم تطويل البحث وحتى لا يخرج عن موضوعه الأصلي، فذكر مسألتين أو ما يقرب منها تكفي ي نظرة لإعطاء الباحث نموذجاً من اثر الاختلاف في القاعدة.
