كيف نعرف العفو؟ وما هو تاريخه وموقعه في التشريعات العربية والمقارنة سيما في القانون الفرنسي ومدى علاقته بالعم الجنائي بشكل عام؟ أسئلة يحاول هذا الكتاب أن يجيب عنها في فصول متتابعة وذلك عبر عرض موضوعي ودقيق للمراحل التي مر بها تاريخ العفو، كما وأنه لا يدعى فتح باب جديد في الموضوع إنما يثير نقاطاً قانونية واجتماعية وسياسية طالما كان التطرق إليها من خلال موضوعات الكتب القانونية الجزائية خاصة، إنما يشكل مقتضب وضيق، ويعرضه كل مؤلف من خلال شرحه لقانون العقوبات في قسمه العام مكتفياً بإيراد المواد التي تكرس هذا النوع من المنح التي تصدرها الحاكم أو لإحدى السلطتين التشريعية والتنفيذية.
كما وأنها محاولة لفهم المعنى الحقيق للعفو سواء من الناحية القانونية الصرفة أن من ناحية تأثيره على الشخص المعفي عنه والمدعي الشخصي، وكذلك الوضع الاجتماعي لكل منهما وانعكاس فنح العفو على الاستقرار والأفق في حال منحه، كما والحكمة منه في كل زمان ومكان.
