يضم هذا الكتاب بين طياته دراسة فقهية مقارنة بينت آراء فقهاء المذاهب السبعة الإمامي، والحنفي والمالكي والشافعي والحنبلي والزيدي والظاهري، في مسألة الوصية وأحكامها، كما وتعرض في بعض المسائل لبيان رأي فقهاء الإباضية، ولآراء بعض أصحاب المدارس الفقهية المندرسة كالأوزاعي وغيره، وفيها اتبع المباحث خطة حسبها جديرة بالملاحظة لما فيها من عدم تشتت ذهن القارئ مع إبعاده عن التكرار والاجتراره مؤدي هذه الخطة، أنه يعرض لمحل النزاع في المسألة المثارة، تم يذكر الآراء المتشعبة حولها، تم يتبع ذلك بأدلة النافين والمثبتين والمفصلين، ثم يختار لنفسه رأياً من تلك الآراء المعروضة، ثم يستدل عليه، ثم يخلص إلى هدم دليل الخصم الذي أقامه على مدعاه.
هذا وقد قسم دراسته إلى بابين مهد لهما بمدخل، عقد جزء منه للتعريف بالوصية لغة، واصطلاحاًن ثم دلل على المراد بها فيما وردت فيه في الكتاب العزيز والسنة الشريفة من موارد، وعقد جزء آخر من المدخل لتعيين نحو من الوصية من مقولة العقد أو من نسخ الإيقاع، وقد ذكر اختلاف الفقهاء في ذلك على قولين، بين كل منهما مع دليله.
أما المبحث الأخير في المدخل فقد عقده للتحدث عن أركان الوصية وعرض لآراء الفقهاء حول هذه الأركان: ثم انتقل في الباب الأول من الكتاب للحديث عن مبررات الوصية، صيغة الوصية ووسائل التعبير فيها، الإشهاد على الوصية، وآراء الفقهاء فيه...
ثم تكلم من الحكمة من تشريع الوصية وذكر أدلة مشروعيتها من الكتاب والسنة والإجماع والعقل، كما أشار إلى مدى دليلة القياس في ذلك، بعد ذلك تكلم حول مثبتات الوصية التملكية المتفق عليها والمختلف فيها، وبين آراء الفقهاء وأدلتها، من ثم تكلم على مثبتات الوصية العهدية، والخلاف الذي دار حول تلك المثبتات، وأخيراً توقف وفي هذا الباب عند مبطلات الوصية وأما الباب الثاني فقد خصصه للحديث عن أركان الوصية وشرائعها وأحكامها.
