إن الزواج عقد مؤبد، غايته إنشاء أسرة مستقرة تنعم بالطمأنية والمودة وقد يعرض له ما يعدل به عن غايته وينأى به عن غرضه، فتصبح الحياة جحيماً بعد أن كانت نعيماً، وكراهية بعد أن كانت حباً ومودة، ومن أهم هذه العوارض الخلاف في ملكية أثاث بيت الزوجية ما بين الزوجين، إذ أن هذا الخلاف قد يؤدي إلى المنافرة والقطيعة وقد يصل الأمر إلى حد الطلاق ما بين الزوجين.
تبحث هذه الدراسة موضوع النزاع في ملكية أثاث بيت الزوجية دراسة مقارنة بين القضاء العراقي والفقه الإسلامي، لكون الشريعة الإسلامية مصدراً من مصادر التشريع في القانون العراقي إستناداً إلى أحكام المادتين (الأولى/2) من القانون المدني و (الأولى/2) من قانون الأحوال الشخصية العراقيين، ولعدم توفر النصوص القانونية الصريحة التي تعالج هذا النزاع، يتوجب على القضاة الرجوع إلى الفقه الإسلامي بمذاهبه المختلفة دون التقيد بمذهب معين، إستناداً إلى النصين الأنفي الذكر فيأخذ القاضي آراء الفقهاء في المذهب الذي يتلاءم مع نصوص القوانين العراقية وعرف البلاد.
ومن الجدير بالذكر أن طبيعة مجتمعنا الإسلامي والشرقي مختلفة عن طبيعة المجتمعات الغربية في كثير من التفصيلات، ومنها أحكام الزواج وآثاره، ومن ثم فإن النزاع في ملكية أثاث بيت الزوجية في تلك المجتمعات ذو طبيعة خاصة، إذ أن الزوجين يتفقان على النظام المالي الذي سيتبع أثناء الحياة الزوجية، ومنه نظام إشتراك الأموال أو فصلها وغيرها، ومن ثم يتم الرجوع إلى هذا الإتفاق عند نشوب أي نزاع في ملكية أثاث بيت الزوجية.
