شرع الإسلام عقد الإجارة، ونص عليه في آيات عديدة، وقام فقهاء الإسلام بوضع أحكام هذا العقد استنباطاً من القرآن الكريم وسنة رسول الله، واسترشاداً بالمبادئ العامة والقواعد الكلية فيما لم يكن فيه نص شرعي وأحاول في هذا البحث أن أعرض لأهم جهود هؤلاء الفقهاء المعاصرين في هذا الموضوع للتعرف على جوانبه المختلفة.
وقد قسمت هذا البحث إلى أربعة مباحث وخاتمة، وهي على النحو التالي: المبحث الأول: تعريف الإيجار المنتهي بالتمليك وأطواره وحكمه في القانون المصري وصوره والمبحث الثاني: اقتران صيغة عقد الإيجار المنتهي بالتمليك بالوعد بالبيع أو الهبة في الفقه الإسلامي والمبحث الثالث: اقتران صيغة عقد الإيجار المنتهي بالتمليك بشرط اليبع أو الهبة في الفقه الإسلامي أما المبحث الرابع: الإيجار المنتهي بالتمليك وبيع التقسيط.
