تحدث الكثيرون من رجال القانون الخاص في بحوثهم ومقالاتهم عن استقلال القاضي الذي لا يخضع لأي تأثير غير ضميره والقانون.
ويتبين من هذا أن رجال القانون الخاص لم يتحدثوا عن استقلال السلطة القضائية وإنما تحدثوا عن استقلال الوظيفة القضائية التي هي إحدى شقي استقلال السلطة القضائية.
أما رجال القانون العام فقد تحدثوا عن القضاء كسلطة ثالثة في الدولة، فلا يكتفي رجال القانون العام بأم يكون القاضي مستقلاً في وظيفته وإنما يجب أن يكون مستقلاً في الكيان الذي ينتمي إليه.
ولقد تناول الدكتور يس عمر يوسف، مؤلف هذه الدراسة، هذا الموضوع من وجهة نظر القانون العام، ول يلجأ إلى القانون الخاص إلا بالقدر الذي يتطلبه موضوع البحث باعتبار أن موضوع القضاء هو شركة بين القانونين العام والخاص.
ولما كان موضوع البحث يعقد دراسة مقارنة بين النظامين الوضعي والإسلامي فقد قسم المؤلف دراسته إلى قسمين: القسم الأول: وخصصه للحديث عن استقلال السلطة القضائية في النظام الوضعي. القسم الثاني: وخصصه لدراسة استقلال السلطة القضائية في النظام الإسلامي.
