موضوع هذا الكتاب، هو عبارة عن عنوانين كبيرين في الفقه الإسلامي، هما: النكاح والطلاق. ومن هنا، جاء الكتاب في فصلين: بحث موضوع النكاح في الفصل الأول منه، ضمن مباحث، يتناول كل منها مفصلاً رئيساً من مفاصله، مع تقسيم كل مبحث إلى مطالب حسب مقتضاه. وفي الفصل الثاني، بحث موضوع الطلاق على النسق نفسه.
وكان المؤلف حريصاً هنا وهناك، على تناول أمهات المسائل التي تدخل في نسيج كل موضوع، مبتعداً عن التطرق إلى ما يؤدي إلى الوقوع في الحشو وما لا ينفع من القول.
وقد نهج في كل مسألة هنا، أسلوب المقارنة بين المذاهب الفقهية الإسلامية الخمسة الكبرى، بعرض مواقفها، مع التطرق إلى ذكر من يكون من فقهاء أي مذهب مخالفاً لموقف المشهور من فقهاء مذهبه في المسألة المطروحة. كما كان يشير في بعض المواضع إلى رأي كل من فقهاء الزيدية والظاهرية، تتميماً للفائدة.
وقد اعتمد في هذا البحث من أوله إلى آخره، فقط، على أمهات المصادر الفقهية الأصلية في كل مذهب من المذاهب. وكان الضابط الذي حكم بحثه كله، هو الموضوعية بكل أركانها، ومنها التجرد عن الروح المذهبية الضيقة.
