تعتبر حالة الضرورة من المبادئ الأساسية في القوانين الداخلية، وتستمد شرعيتها وشروط تحققها من البناء القانوني الذي تنشأ فيه.
وتمثل حالة الضرورة فكرة قانونية ثابتة وراسخة في التشريعات الداخلية ومصطلح موجود في كل فروع القانون، إلا أنها تختلف من حيث ماهيتها، وطبيعتها، وشروطها في كل فرع من فروع القانون الداخلي، ولم تقتصر الضرورة على القانون الوضعي، بل إن الشريعة الإسلامية لها موقفاً متميزاً معها أيضاً.
وتنهض حالة الضرورة في الوقت الذي تتعرض الدولة فيه ببنائها القانوني وديموتها المرفقية ومؤسساتها الدستورية إلى خطر جسيم يهددها، ولا يمكن درء الأخطار المحدقة بها من خلال الوسائل الممكنة والموجودة في الظروف الطبيعية، فتلجأ الدولة بمواجهة الأزمات الطارئة بوسائل إستثنائية تمكنها بالمحافظة على كيانها ووجودها القانوني.
وعليه، فإن هذه الدراسة تهدف إلى إبراز المعالم التاصلية الأساسية لحالة الضرورة في القانون الدولي العام من جهة، والقانون الدولي الإنساني من جهة أخرى، وتحديد علاقتها بالإعتبارات الإنسانية وصولاً إلى الآثار القانونية المترتبة عليها.
وفي ضوء ما تقدم تم تقسيم الرسالة إلى فصلين، يسبقها بفصل تمهيدي حول مفهوم القانون الدولي الإنساني من حيث تعريفه وتميزه عن غيره في المبحث الأول، وبحث أهم القواعد الأساسية له في المبحث الثاني، يُعنى الفصل الأول ببيان مفهومي الإنسانية والضرورة، أما الفصل الثاني فيوضح أهم قواعد القانون الدولي الإنساني القائمة على حالة الضرورة (العراق نموذجاً)، وختم المؤلف بالتوصيات والإستنتاجات التي توصل إليها.
