يتضمن هذا الكتاب أعمال ورشة عمل عقدها المركز اللبناني للدراسات برعاية الوزير جوزيف شاوول عالجت جوانب أساسية من عملية إعداد القضاة اللبنانيين وتأهيلهم وتطورهم المهني في مجتمع وعالم يتغير بسرعة ويزداد تعقيداً وتنوعاً في المسائل والأمور المطروحة على القضاة اليوم.
ويتطلب هذا العالم الجديد تطويراً مستمراً في أساليب إعداد القضاة اللبنانيين ومناهجه ومضامينه، على أمل أن يساهم هذا الكتاب في الحوار حول متطلبات إصلاح وتدعيم المؤسسات العامة في لبنان، بداً بالمؤسسة القضائية التي يعوّل عليها الكثير في نهضة لبنان وإرساء قواعد ومستلزمات العدل في ربوعه.
يرتكز بناء الدولة على أسس ثلاثة تمثلها السلطات التشريعية والتنفيذية والقضائية، ولا يستوي دور السلطتين التشريعية والتنفيذية إلا بوجود سلطة قضائية متطورة وفاعلة ومستقلة تمارس رقابتها الدستورية على أدائهما وتسوّد حكم القانون في المجتمع.
لكن على الرغم من أهمية تطوير السلطة القضائية على مستوى النصوص القانونية والمؤسسات فإن نجاح العمل القضائي يظل متأثراً بشخصية القاضي وبكفاءته وخبرته وجرأته، وهي أمور ترتبط بدورها بطريقة إعداده.
يتضمن هذا الكتاب أبحاث مناقشات المؤتمر الذي عقده المركز اللبناني للدراسات بالتعاون مع مؤسسة كونراد أديناور ومعهد الدروس القضائية للبحث في شؤون القضاة في لبنان ودور معهد الدروس القضائية في إعدادهم. وقد شارك في أعمال المؤتمر نخبة من رجال الفكر ومن أعلام التشريع الذين تناولا في أبحاثهم ومناقشاتهم مختلف المجالات المساهمة في إعداد القاضي النموذجي في لبنان، بدءاً بمناهج التعليم والجسم التعليمي في معهد الدروس القضائية، وبالأوضاع الإدارية والمالية في المعهد، مروراً بوسائل استقطاب القضاة ومواصفات المرشحين، مروراً بالمعلوماتية الحديثة في التثقيف القضائي، وبتخرج القضاة وتوزيعهم على المحاكم، وصولاً إلى موقع المرأة في القضاء اللبناني والظروف الاجتماعية والوظيفية المؤثرة في دورها المعني في القضاء.
