أصل هذا الكتاب رسالة ماجستير في جامعة أم القرى قسم الدراسات العليا الشرعية بفرع الفقه والأصول في كلية الشريعة. وقد نوقشت سنة 1412هـ1992م وأجيزت بتقدير "ممتاز" بإشراف فضيلة الأستاذ أحمد فهمي أبو سنة، وفيها تحدث المصنف عن الإجماع باعتباره أحد الأدلة الشرعية التي تثبت بها أحكام الفقه، وباعتبار أن منزلته جاءت بعد كتاب الله وسنة رسوله.
أما منهجه في البحث فيعتمد علة ذكر القاعدة الأصولية في كل مسألة، وتحرير محل النزاع فيها إذا وجد، ثم عرض آراء الأصوليين، ثم ذكر الأدلة لكل فريق مع مناقشتها، معتمداً في كل ذلك على المصادر الأصولية الموثوق بها لكل مذهب. وبالرجوع إلى أقسام البحث نجد أن المؤلف قد قسمه على تمهيد وبابين، في التمهيد تحدث عن تعريف الإجماع لغة واصطلاحاً، وفي حكم الإجماع على الأحكام الحسّية والعقلية واللغوية والدنيوية، وفي تحقق أمور ليست من الإجماع. وفي حجية الإجماع، والإجماع السّكوتي، شروط الإجماع، وطرق نقل الإجماع ومراتبه، وفي الباب الأول تحدث عن آثار الإجماع مبيناً حكم الإجماع القطعي وحكم الظني وحكم الإجماع على قول ثالث إذا اختلف المجتهدون على قولين: وحكم الإجماع مع غيره من الأدلة، أما الباب الثاني فجعله باباً تطبيقياً وضمنه دراسة في إجماعات ابن المنذر في كتاب (الإجماع) وابن حزم في كتابه (مراتب الإجماع).
