Book Description
إن للإجماع أهمية كبيرة بإعتباره أحد أهم أربعة مصادر للأحكام الشرعية، وجعلوه في المرتبة الثانية بعد نصوص الكتاب والسنّة، بل زعم بعضهم أنه أقوى منهما في الدلالة على الأحكام الشرعية، وعلى الرغم من أنهم قالوا: إن الإجماع مظهر لحكم الله لا منشى له؛ لأن المجمعين إنما يدورون في فلك النصوص الشرعية، ولا يتجاوزونها كما هو القياس، إلا أنه يعطي الأحكام الشرعية نوعاً من القوة، ويورث في نفوس الناس قناعة وحسن قبول.
وبالإجماع حُفظ الكثير من أمور الدين، وتحول ما هو ظني في ثبوته أو دلالته إلى قطعي، وحُفظ ما اتفق عليه المسلمون من الثوابت التي لا تختلف بإختلاف الزمان أو المكان، ولهذه الأهمية أولاه كثير من الباحثين عنايتهم، فظهرت طائفة كثيرة من الكتب منها ما هي رسائل علمية، سواء كانت للدكتوراه أو الماجستير، ومنها ما كانت بحوثاً لغير ذلك الغرض.
وسأكتفي بذكر ما اطلعت عليه مما هو مطبوع منها، معرضاً عن ذكر ما هو من البحوث والرسائل المخطوطة المحفوظة في مكتبة كلية الشريعة والقانون في جامعة الأزهر، وبعض مراكز البحوث والمكتبات الملحقة بها.
