عند قراءة اسم الكتاب يجد القارئ للوهلة الأولى ان موضوع الاجراء الجزائي الباطل في نطاق الاجراءات الجزائية يحظى بأهمية خاصة والتي تنبع من اهمية الاجراءات الجزائية نفسها مع ما تستند اليه من قواعد تحتوي ضمانات على درجة كبيرة من الاهمية والتي تتأصل غايتها في اظهار الحقيقة. وقد تضمن الكتاب فصلاً تمهيدياً وثلاثة أبواب يحتوي كلٌ منها على عدة فصول، تحدث الفصل التمهيدي عن القاعدة الاجرائية والمركز القانوني للمتهم، ثم انتقل المؤلف بعدها للباب الأول والذي تحدث عن تأصيل الاجراء الجزائي الباطل، تناول في الفصل الأول ماهية الإجراء الجزائي الباطل، وتناول الفصل الثاني مناط الاجراء الجزائي الباطل وتقسيماته، أما الفصل الثالث فتناول نظرية البطلان في التشريعات المقارنة، أما الباب الثاني فجاء بعنوان القواعد المنظمة للإجراء الجزائي الباطل، وتناول الفصل الأول منه موضوع مقومات الإجراء الجزائي الباطل، والفصل الثاني تناول محددات بطلان الإجراء الجزائي، أما الباب الثالث فتحدث عن تطبيقات الإجراء الجزائي الباطل، وتناول الفصل الأول منه موضوع مخالفة الإجراء الجزائي لقواعد التحقق الابتدائي، والفصل الثاني تحدث عن مخالفة الإجراء لقواعد التحقيق النهائي (المحاكمة).
