لا يمكن للمشترع، مهما أوتي من بعد في النظر ومهما تحسب لما يمكن أن يطرأ من مشاكل ومنازعات، أن يضع الحلول المسبقة لما يمكن أن يطرحه القانون من عقد وتساؤلات.
من هنا كان دور الفقيه وكانت مهمة القاضي: الأول يبدي آراءه العلمية شارحاً النص ومعلقاً عليه ومنتقداً له؛ والثاني يأخذ على عاتقه أمر التطبيق ووضع الحلول القانونية موضع التطبيق العملي.
وكثيراً ما يأتي تكامل النص، عن طريق تعديله، ثمرة لعلم الفقيه وتطبيق القانون من قبل القضاء.
من هنا كان من الأهمية بمكان أن يبقى رجل القانون على إطلاع دائم على آراء من سبقه في معاناة النص القانوني لا سيما على ما صدر عن المحاكم من إجتهادات تصبح، مع الزمن، مناراً يسترشد بها كل طالب علم أو رجل قانون.
ولا يخفى ما يهدره الساعي وراء المعرفة والرأي الصائب من وقت وجهد للوصول إلى غايته.
ومن أجل التوفير في الوقت والجهد كان هذا المصنف، إذ بدلاً من اللجوء إلى البحث هنا وهنالك سيجد رجل القانون نفسه امام مجموعة الإجتهادات الصادرة عن المحاكم في القضايا والمشاكل التي يثيرها تطبيق قانون العقوبات، وهذه المجموعة مصنفة ومبوبة حسب مواضيعها. وقد إتبع في تصنيف هذه الإجتهادات الأسلوب التالي:
أوردت نماذج عن الإجتهادات المتعلقة بنقطة قانونية معينة ومعها بعض القرارات المماثلة. وفقاً للحاجة أوردت موجزاً للإجتهاد المعني. وقدم خلاصة للحكم المقصود مع شيء من التوسع. وأحياناً أخرى كما أورد القرار بكامله نظراً للتفصيلات الواردة فيه والتي من الضرورة عرضها.
من أجل العثور على الإجتهاد المطلوب ليس على القارئ إلا أن يبحث، في الفهرس، عن الموضوع الذي يريد، ومن ثم وفي صلب هذا الموضوع يفتش عن العنوان الفرعي فيصل إلى مبتغاه.
