إن موضوع "عقود الزواج الفاسدة في الإسلام" من الموضوعات الحيوية التي اختلف فيها كلمة الفقهاء وتعددت آراؤهم. كما أنه موضع الاستيضاح والاستفتاء عند الكثير من الناس وهم كثيراً ما يقعون في محظور الزواج بالمحرمات، رضاعاً أو مصاهرة، أو في غيرها من العقود الفاسدة كالنكاح بدون ولي عند القائلين به، أو نكاح التحليل أو النكاح في العدة إلى غير ذلك من الأنكحة المحرمة كالشغار والمتعة ونكاح السر مثلاً.
وكتاب "عقود الزواج الفاسدة" ثمرة جهد أكاديمي لمؤلف درس الفقه الإسلامي لمدة تزيد عن ثلاثة عقود، فكان كتابه هذا جميعاً لشتات ما تفرق بين المصنفات الكبيرة في موضوع محرمات النكاح واختلاف الفقهاء، وآرائهم حول هذا الموضوع. والطريقة التي اتبعها الباحث أثناء إعداده لهذا الموضوع هي أنه اعتمد في جمع مادته على الرجوع إلى المصدر السماوي الأعلى وهو القرآن الكريم، والاطلاع على ما تيسر له من التفاسير المختلفة، ثم على سنة النبي صلى الله عليه وسلم بالبحث في الكثير من كتبها العديدة وشروحها، ثم على آراء وأقوال السلف من الصحابة ومن بعدهم من الفقهاء المجتهدين وأئمة الدين وفقهاء الشريعة.
أما ترتيبه لعقود الزواج الفاسدة التي تناولها بالذكر كان بأن ذكر ما اشتمل على خلل في العقد، بعد الإشارة إلى زواج العرب قبل الإسلام، وما أبقاه الإسلام منها، وما أبطله، ثم ما اشتمل على خلل في المحل وذكر في الفصل الأخير أنواع من الأنكحة الفاسدة. أما عرض المحرمات فرتبها في الفصل الثالث بحسب قوة تحريمها، فابتدأ بالمحرمات على التأبيد ثم المحرمات على التأقيت. وبين في كل مسألة آراء الفقهاء وموضوع اتفاقهم واختلافهم والسبب في هذا الاختلاف. وأدلة كل منهم على ما ذهب إليه ووجه دلالتها.
