من زاويتي المفهوم القانوني للجريمة وأركان هذه الجريمة، وهو بذلك وبالتالي جاءت هذه الدراسة على قسمين، يتناول القسم الأول المفهوم القانوني لجريمة الإبادة الجماعية حيث يتطرق لتعريف الإبادة الجماعية، الأساس القانوني لجريمة الإبادة الجماعية، أشكال الإبادة الجماعية الجماعات المستهدفة في جريمة الإبادة الجماعية (الجماعات الضحية) أما القسم الثاني فيتناول أركان جريمة الإبادة الجماعية، حيث يتحدث عن الركن المادي لهذه الجريمة والركن المعنوي، من ثم يميز بين جرائم الحرب، الجرائم ضد الإنسانية وجريمة الإبادة الجماعية.
