يعد التأمين في وقتنا الحاضر من أهم الدعامات التي يقوم عليها تطور حضارتنا الراهنة لأن وجوده ساعد في ازدهار الحياة الاقتصادية واستقرار الأوضاع الاجتماعية بالإضافة إلى أنه من أهم مظاهر التعاون الدولي، ففي أي مجتمع من المجتمعات يعد التأمين من أهم المقاييس التي يمكن على أساسها تحديد مدى وعي الشعور بالمسؤولية.
وتقوم فكرة التأمين على وجود خطر يهدد مصلحة مشروعية للمؤمن له يقوم المؤمن بتغطيته في حالة تحققه عن طريق التعويض المالي، وعليه فإن التأمين يتطلب توافر ثلاثة عناصر أساسية هي الخطر والقسط والتعويض المالي.
من أجل البحث القانوني الذي قمت به "عنصر الخطر في التأمين" جمعت عدداً كبيراً من قرارات محكمة التمييز الأردنية المتعلقة بالتأمين ولإطلاعي على المكتبات القانونية العامة منها الخاصة وجدت أنها تفتقر لوجود كتاب بهذه الصورة.
لذلك بدأت عمل الكتاب هذا على فكرة وضع القرار التمييزي، بعد بلورته وإذابته على الفهرست -بعناصر الثلاث المبدأ القانوني والحكم والقرار، للباحث، بتوضيح وفهم صورة وضع المبدأ القانوني بالإطلاع على حيثيات القرار.
إذابة القرارات على الفهرست، بمعنى إن الفهرست هو المغنطيس الذي به يمكن الحصول على القرار من الحوض الكبير، فقد قسمت فهرست الكتاب إلى تسعة وأربعين موضوعاً جميعها تتعلق بالتأمين وما هو وثيق الصلة به، فكان القرار الواحد يقع تحت عدة موضوعات فمثلاً قرار رقم 39/99 وارد تحت الموضوعات التالية وذلك منعاً للتكرار هي "طلب إدخال"، "الشروط الواردة في عقد التأمين"، "إبراء"، "عقد إذعان".
