يشكل الاعتماد المستندي حالياً الوسيلة الأنجح لتسوية عمليات البيع الدولية، حيث يضمن للبائع حصوله على ثمن بضائعه وبالمقابل يضمن للمشتري استلامه البضاعة وذلك عن طريق طرف ثالث وسيط هو المصرف.
ونظراً لقلة التشريعات، قامت غرفة التجارة الدولية بوضع قواعد وأعراف دولية موحدة تتعلق بالاعتمادات المستندية لتجنب النزاعات والخلافات الناشئة عن اختلاف العادات والأعراف بين الدول.
وقد زادت أهمية الاعتماد المستندي بعد ظهور مصطلح العولمة وانفتاح الأسواق التجارية الدولية على بعضها البعض مما جعل العالم كالقرية الصغيرة وأيضاً ظهور وسائل الاتصال الحديثة وخصوصاً الإنترنت وشيوع استخدام المستندات والتواقيع الإلكترونية. فأصبحت العمليات التجارية الدولية تتم عن بعد فكان ما عرف بالتجارة الإلكترونية.
إن هذا الأمر دفع غرفة التجارة إلى مواكبة هذه التطورات في حين ظل الجمود يهيمن على التشريع اللبناني وربما يشكل دراسة مشروع القانون الذي تقدمت به الحكومة عام 2000 والمتعلق بالإثبات بالوسائط الإلكترونية جزء من الحل لمواكبة هذه التطورات وحماية للمستورد اللبناني.
في هنا كان لا بد من التطرق إلى موضوع الاعتماد المستندي نظراً أهميته على صعيد التجارة الإلكترونية وذلك من خلال دراسة القواعد والعراف الدولية الموحدة الصادرة عن غرفة التجارة الإلكترونية ومقاربتها لواقع التشريع الداخلي والمقارن من خلال قسمين: قسم الأول بعنوان دور الاعتماد المستندي في تطوير التجارة الدولية والقسم الثاني بعنوان الآثار القانونية الناشئة عن الاعتماد المستندي مضيفاً سبع ملاحق تسهل عمل المصارف وتبسط عملية الإحاطة بالموضوع والتعمق به.
