إن الشفعة حق يجيز لصاحبه أن ينتزع العقار المبيع من المشتري في الأحوال وبالشروط المنصوص عليها في القانون علماً أن دعاوي الشفعة من الدعاوي العينية العقارية المعينة القيمة.
والشفعة تمنع تعدد الشركاء وتجزئة العقارات وتبعد أذى الدخيل ومضايقات الجوار ويسري حق الشفعة على العقارات الملك وعلى العقارات الأميرية كما يجوز الشفعة في العقارات غير الممسوحة.
