يضم هذا الكتاب دراسة أكاديمية اهتمت بتسليط الضوء على موضوع الشفعة في قانون المعاملات المدنية السوداني لسنة 1984م مقارناً بالفقه الإسلامي، والذي دعا المؤلف لتناول موضوع الشفعة في رسالته هذه هو ندرة ما كتب في هذا الموضوع على سبيل الاستقلال والفرادة عن موضوعات الملكية الأخرى عموماً، وعدم الكتابة في موضوع الشفعة السوداني، إلا نادراً مع ملاحظة أن الذي كتب في قانون الشفعة السوداني كان متعلقاً بالقانون القديم، قانون الشفعة لسنة 1928م.
أما مسألة الشفعة في القانون الجديد قانون المعاملات المدنية لسنة 1984م، فلم يتعرض أحد من المهتمين بالشؤون الفقهية والقانونية للكتابة فيها إلا ما ورد في مذكرة مهدي محمد أحمد قاضي المحكمة العليا من تعليق على بعض مواد هذا القانون.
وهكذا سعى المؤلف في متن دراسته هذه لطرق موضوع الشفعة متبعاً منهجاً يقوم على تقسيم الدراسة على سبعة أبواب عقد كلاً منها لموضوع من موضوعات الشفعة فدرسه في القانون والفقه من ثم أجرى مقارنة بينهما، فعرف بداية بالشفعة في اللغة والاصطلاح والقانون، من ثم ذكر سبعة عشر حديثاً نبوياً ورد في الشفعة، بعدها شرح ما يستفاد من متن كل حديث وأتبعه ببيان موقف المذاهب الأربعة من هذه الأحاديث، وأفرد باباً خاصاً لشرح أسباب الشفعة في الفقه والقانون، وآخر خصصه لشروط الشفعة في القانون والفقه.
أما في الباب الخامس فتناول موضوع تزاحم الشفعاء في القانون أيضاً والفقه، ورد في باب خاص على سؤال كيف يمكن الأخذ بالشفعة وما هي آثار الشفعة، أما الباب السابع فخصصه لموانع الشفعة ومسقطاتها وما يعتبر تحايلاً في مجال الشفعة.
