يبين هذا الكتاب أهمية النقل في الحياة الاقتصادية إذ يعتبر أحد وسائل التداول وحلقة الوصل بين الإنتاج والاستهلاك ونقل الأشخاص لا يقل أهمية عن نقل الأشياء إن لم يزد عليه فعلاوة على أن له أهمية اقتصادية فإن اتصال تنفيذ هذا العقد بجسم الراكب وحياته جدير بحماية خاصة يهيئها له المشرع أولا انطلاقا من كون هذا الإنسان هو الأساس في البناء والتقدم وتطوير الحياة الاقتصادية والاجتماعية وثانيا لموقع النقل في خطط التنمية القومية، ثم يتناول الكتاب في الباب الأول طبيعة مسؤولية الناقل البري في فرنسا ومصر والعراق وإلى أساس مسؤولية الناقل وإلى نظريات الخطأ في دراسة الأشياء ونظرية الضمان ونظرية الضرر وهي النظرية المدنية حيث يطالب الراكب المتضرر بإثبات الضرر وافتراض علاقة السببية دون البحث عن وجود خطأ من جانب الناقل أم لا. ويتناول في الباب الثاني سريان مسؤولية الناقل من حيث الزمان وسريان المسؤولية في النقل بالسيارات وسريان المسؤولية بالنقل بالسكك الحديدية ثم بيان موقف الفقه وقوانين التجارة ويشير أيضا إلى الالتزام بضمان سلامة الراكب وبيان مضمون هذه السلامة بالفقه وقوانين التجارة ، والالتزام بالوصول إلى المكان المقصود وبالميعاد المعين والالتزام بنقل الأمتعة، ثم ينتقل إلى الضرر الناتج عن المساس بسلامة المسافر أو عن عدم تهيئة المكان والراحة والتأخير وهلاك وتلف الأمتعة وموقف الفقه وقوانين التجارة ويشير في الباب الثالث إلى الأسباب القانونية للإعفاء من المسؤولية ويعدد منها القوة القاهرة والحادث الفجائي وفعل الغير وفعل المسافر وموقف الفقه والقانون من ذلك كله.
