إن اجتهادات قضاء الأمور المستعجلة، في لبنان غنية ووفيرة ونوعية، ويتناول هذا الكتاب جانباً مهماً من الاجتهادات الصادرة ما بين عام 1987 وعام 1997 وهي تتناول مختلف المواضيع التي تعرض على القضاء المستعجل: من عجلة واختصاص وأشغال دون مسوغ شرعي وسلفة وقتية وتدابير مؤقتة وتدابير مؤقتة واحترازية وغرامة إكراهية وغيره.
وقد تطور الاجتهاد اللبناني في قضايا الأمور المستعجلة تطوراً حثيثاً بالرغم من حداثته، وعرف لبنان القضاء المستعجل لأول مرة في المرسوم الاشتراعي تاريخ 03/02/1930، في حين أن أصل القضاء المستعجل في فرنسا يعود إلى أمد بعيد وإلى عام 1685 تحديداً.
وإذا كان اللجوء اليوم إلى القضاء المستعجل من الأمور الأساسية والحيوية والبالغة الأهمية بالنسبة للمتقاضين والمواطنين، والحاجة الملحة إلى السرعة والعجلة في رفع ضرر وحسم نزاع وإزالة خطر، فإن القضاء المتعجل أصبح يشغل حيزاً في النزاعات وفي مختلف أنواع الدعاوى وله ميزته وخصوصيته وأطره وأهدافه ونطاقه، وهو يهدف إلى اتخاذ تدابير عاجلة ووقتية تقتضيها الضرورة، وحتمية الخروج من إتباع الإجراءات العادية الروتينية في المحاكمة التي قد تأخذ وقتاً طويلاً إلى إتباع أصول خاصة بالقضاء المستعجل تتميز باختصار المهل وسرعة البت في الدعاوى المستعجلة وفي التدابير المطلوبة والاستعجال في التنفيذ.
ويعرف القضاء المستعجل بأنه قضاء "وقتي" إذ لا يحسم النزاع المعروض عليه بشكل نهائي ولا يتمتع القرار الصادر عنه بقوة القضية المحكمة، ويمكن تعديل مثل هذا القرار أو إلغاؤه إذا تغيرت الظروف أن اقتضت ذلك الأحوال المتبدلة من قبل قاضي الأمور المستعجلة ذاته، فيكون من باب أولى أن مثل هذا القرار لا يقيد المحكمة الناظرة بأساس النزاع والوضعية يدها على موضوع الحق، بل يتعلق مصيره بالحل النهائي الذي يعطى للدعوى.
