في كتابه هذا ، يطرح الدكتور خليل الدحداح موضوع " المساكنة " للنقاش من وجهة نظر قانونية بحتة دون النظر إلى انعكاسها الإجتماعي ، أو إلى مبرراتها الفلسفية والسيكولوجية ، لتبرير مبدأ ، أو خط قانوني ، أو تنظيمي متبع أو مقترح في مجال معيّن ، بل يسعى لإيجاد الأسس والمرتكزات والقواعد التي تحيط بها وترعاها من شتى الجوانب ؛ لخلق نوع من نظام يدخلها في إطار قانوني ، ويجنّب سلبيات بقائها متفلّتة أو متجاهلة .
وفي هذا السياق ، يبدأ المؤلف بدراسة ميزاتها ، وذلك عبر عرض أوضاع قانونية ، أو حالات شاذة مشابهة لها ، أو فيها بعض الأوجه المشتركة معها ، ومن ثمّ مقارنتها بها ، وذلك قبل تعريفها وبيان خصائصها ، والتعريج على الأحكام المناهضة لها ، وتلك التي ترعى بعض جوانب منها ، من زاوية قبولها أو عدم قبولها ، وحتى ولوج آثارها ومترتباتها العملية والقانونية كافة ، وصولاً إلى اقتراح نظام يضبطها ويحيط بها .. والقانون الذي يقترحه المؤلف ، مقتبس من مجموعة أفكار ومفاهيم غالبيتها شخصية وبعضها الآخر متأثر بالإجتهاد الفرنسي ، وعدد من النصوص المتفرقة ، دون إهمال الفقه ودراساته ، إلى ذلك ، تم التوسع في معالجة قضايا القاصر الناشئ عن علاقة المساكنة ، والغرض مواكبة العصر لناحية الإقرار له بحقوق أي ( القاصر ) ، لا يوجد لها حضور في القوانين السائدة .
