أثر إنتهاء الإنتخابات النيابية صيف 1996، نشرنا بحثاً تناولنا فيه قانون الإنتخابات النيابية، والطعون فيها، وصلاحية المجلس الدستوري، مع بيان أهم المبادئ التي كرستها النصوص القانونية اللبنانية السائدة، وعلى سبيل الإستئناس، أهم المبادئ المعتمدة من المجلس الدستوري في فرنسا في هذا الحقل، بسبب التقارب بين النظامين.
وأثر صدور القرارات في الطعون المقدمة بالإنتخابات إياها في 1997/5/17، نشرنا بحثاً علقنا فيه عليها، مبينين أهم المبادئ التي اعتمدها المجلس الدستوري اللبناني، سواء في قرارات إبطاله الإنتخاب أم في قراراته رد طلبات الإبطال.
وبالنظر لأهمية الموضوع وحداثته في لبنان، قررنا جمع البحثين والنصوص الكاملة للقرارات وإصدارها في كتاب واحد، تعميماً للفائدة، خاصة وإن المبادئ المعتمدة تصلح أساساً للإستئناس به على الأقل.
إلا أن الحديث بدأ يدور حول بعض التعديلات التي سوف تدخل على قانون الإنتخابات عامة، بمناسبة الإعداد للإنتخابات البلدية في ربيع 1998، الأمر الذي حملنا على تأخير إصدار كتابنا بإنتظار ما ستحمله التشريعات الجديدة من جديد.
وبالفعل، صدر في 1997/12/29 القانون الرقم 665 (نشر في الجريدة الرسمية العدد 59 تاريخ 1997/12/30) وهو يحتوي على تعديلات لبعض النصوص في قانون إنتخاب أعضاء مجلس النواب (فضلاً عن قانون البلديات وقانون المختارين)، خاصة القوائم الإنتخابية، ولجان القيد ومهماتها، والأعمال الإنتخابية.
وما تجدر الإشارة إليه، إن في هذه التعديلات، يأخذ المشترع ببعض ما ذهب إليه المجلس الدستوري في قراراته، وحتى ببعض ما ذهبت إليه المخالفات، وعليه، اقتضى إضافة باب يُعنى بهذه التعديلات.
ومن أجل أن تكون الفائدة أشمل، فقد رأينا أن ننشر أيضاً في هذا الكتاب، وفي الباب الأخير منه، النصوص القانونية التي ترعى المجلس الدستوري وعمله، ليتسنى للقارئ العودة إليها دون عناء.
