تعاني مجتمعاتنا في هذه الظروف الحرجة، من سقم وفشل القوانين الوضعية، ومن فقدان العدالة الإنسانية التي تفتقر إليها المسلمون بل الناس أجمعون، كان من الواجب؛ لذا اختار المؤلف موضوعاً له علاقة بالقضاء، لأن القضاء أمر لازم لقيام الأمم وسعادتها وحياتها حياة طيبة مستقرة فالهدف من قيام النظام القضائي تحقيق العدالة بين المتنازعين وحفظ الحقوق لأصحابها فالعدل أساس الملك.
ولما كان معظم الناس في هذا الزمان يستهينون بحلف الإيمان ولا يهابون عواقبها الوخيمة بل لديهم الإستعداد لقلب الحقائق وتزييفها بأيمان الزور والبهتان، لذا جاء موضوع هذه الرسالة في "اليمين" كوسيلة من وسائل الإثبات في القضاء الإسلامي.
ويعتبر اليمين آخر إجراء ثبوتي يقوم به القاضي بعد أن يعجز المدعي عن إثبات دعواه بوسائل الإثبات المتعددة، وعليه فإن اليمين في هذه الحالة تحسم موضوع الدعوى لصالح أحد المتنازعين.
فاليمين تضع صاحبها في إختبار إيماني صعب: فإما أن يحلف صادقاً بارّاً بغض النظر عن النتائج المترتبة على حلفه، وإما أن يغمس نفسه بالإثم والعدوان ويكون قد ارتكب كبيرة من الكبائر، ولشدة إثمه فإن جمهور الفقهاء يرون بأن حالف الزور لا كفاءة عليه، لأن الكفاءة لجبر الإثم.
من هنا، عرض المؤلف آراء الفقهاء وأدلتهم وبخاصة أصحاب المذاهب الفقهية الأربعة (الحنفية والمالكية والشافعية والحنابلة) في جميع المسائل التي تعرض لها، كما ذكر مذهب الظاهرية في غالب الأحيان، وآراء الأوزاعي والليث وأبي ثور والهادوية في بعض الأحيان على ضوء المصادر والمراجع المتوفرة.
ثم لجأ إلى الترجيح في المسائل الخلافية حسب قوة الدليل، ورجاهة الرأي.
