يشكل هذا الكتاب دراسة مقارنة بين الفقه الدستوري الغربي والنظام السياسي الإسلامي وتبحث في مقدمات الدولة القانونية وضمانات تحقيقها بقصد إبراز فضل الشريعة الإسلامية في خلق مفهوم الدولة القانونية وبيان جلال مبادئها عند مقارنتها بالقيم الدستورية الليبرالية. كل ذلك يأتي من خلال محاولة الكاتب رسم الصورة المثلى للدولة القانونية في النظام السياسي الإسلامي من خلال نصوص الكتاب، والسنَة، والسوابق الدستورية في عصر النبي والراشدين وشرح العلماء لكل ذلك.
وبناءً على ما تقدم قسمت الدراسة إلى مقدمة وفصلين وفصل ختامي ثم نتائج البحث، تناولت المقدمة: التعريف بالدولة القانونية ونشأتها وتطورها التاريخي باتجاه دولة القانون ومبدأ المشروعية، ودور الإسلام المتفرد في ذلك. وتناول القسم الثاني: ضمانات تحقيق الدولة القانونية في الفقه الدستوري الحديث، وفي النظام الاسلامي من خلال مركز السلطات الثلاث ووظائفهما في النظام الاسلامي وهي: السلطة التشريعية والسلطة التنفيذية والسلطة القضائية، وأخيراً خاتمة واستنتاجات.
